01About these terms
These terms apply to your use of this site, which is run by DJ Cy (“we”, “us”). By using the site you agree to them, so please read them alongside the privacy policy and cookie policy. If you don’t agree, please don’t use the site.
02Using the site
You’re welcome to browse, listen and share links. When you do, please don’t:
- use the site for anything unlawful, or to harass, threaten or impersonate anyone;
- try to get into accounts, areas or data that aren’t yours, or test, probe or disrupt the site’s security;
- scrape the site, or send automated or bulk messages through its forms;
- upload or send anything containing malware.
03Member accounts
A free member account unlocks full-length tracks, downloads and members-only playlists in the vault. You must be 13 or over to join. Please give accurate details, keep your password to yourself and don’t share your account. You’re responsible for what happens under it.
If you add a profile photo, it must be one you have the right to use, and nothing offensive, misleading or someone else’s likeness without their permission. We may remove a photo that breaks this.
You can close your account at any time from your account settings. A closed account can’t be used, and can be restored within 90 days if you change your mind or didn’t close it yourself; after that it’s erased for good. We may suspend or close an account that breaks these terms, and we’ll tell you why unless the law or the safety of others means we can’t.
05Music, previews and downloads
Guests can hear 30-second previews. Members can stream full-length tracks and download them where we offer them: each playlist says whether its tracks are full length, downloadable or previews only, and some tracks are previews only for members too. Tracks that are for sale are previews only until you buy them (see Ordering from the store). Members can also watch replays of past shows hosted on the site (replays are to watch on the site only, not to download). Either way, the music and video are licensed to you for personal, non-commercial use only. Ownership doesn’t pass to you. Without written permission you may not:
- re-upload, share, sell or give away tracks, downloads or replays, or record replays;
- play them in public, broadcast them or use them in your own mixes, videos or productions;
- remove or change any credits or metadata.
This licence ends if your account is closed or you break these terms. What’s in the vault, and whether a track can be streamed or downloaded, may change over time. Releases in the catalogues on the site may be by other artists, who keep the rights in their own work.
06Intellectual property
The music, mixes, artwork, design and text on this site belong to DJ Cy or are used with permission. Ruthless Digital releases belong to their artists and the label, and many gallery photos and flyers belong to the photographers and promoters who made them. If you own something shown here and want it credited or removed, and we’ll sort it quickly.
07Bookings and messages
Sending a booking request doesn’t confirm a booking. A booking is only confirmed when we agree the date, fee, set times and any other details with you in writing, and those agreed terms then apply to the event.
Once a booking’s confirmed, we may ask for its fee to be paid through the site:
- Paying. We email a link to the address we agreed. You need a member account with that email address, confirmed, to pay. You can pay by card or in bitcoin, and the payment terms in Ordering from the store apply to it, including the time allowed to pay and how bitcoin payments work. We email a receipt once it’s paid, and it shows under Your orders.
- What you’re paying for. The payment is for the booking as we agreed it. Paying doesn’t change anything else we agreed, and if anything in the payment request doesn’t match, before you pay.
- Cancelling. A booking is a performance on a date we’ve agreed, so the 14-day right to cancel that applies to most things bought online doesn’t apply to it (Consumer Contracts Regulations 2013, regulation 28(1)(b)). If either of us needs to cancel or move it, what happens to the fee is as we agreed in writing. If nothing was agreed and we cancel, we’ll refund you in full.
- Refunds go back the way you paid, as for store orders.
Please keep messages respectful. We may not reply to messages that are abusive, unlawful or clearly spam.
08Ordering from the store
You need a member account with a confirmed email address to order, and we deliver merch to UK addresses only. Prices are in pounds, and delivery is shown at checkout before you pay.
- Your order. Placing an order is an offer to buy. It’s accepted when your payment is confirmed and we email your receipt. Until you pay, we hold the items for you for the time shown at checkout; after that the order is cancelled and nothing is taken. If we can’t supply something after all, we’ll tell you and refund you in full.
- Paying by card. Card payments are taken by Stripe on its own secure page.
- Paying in bitcoin. Send exactly the amount shown, to the address shown for your order, before the time shown. The amount is fixed in pounds at the exchange rate when you ordered. The order goes through once the full amount has a confirmation on the blockchain. If a payment arrives short or after the order’s been cancelled, and we’ll either complete the order or arrange to send it back.
- Delivery. We’ll email you when your order is on its way. If it hasn’t arrived within 30 days of your payment, .
- Changing your mind. You can cancel within 14 days of your order arriving, without giving a reason, by . Send the items back within 14 days after that, unused and in their original condition; you pay for the return postage unless they’re faulty. We’ll refund what you paid, including standard delivery, within 14 days of getting them back. This doesn’t apply to sealed music, such as a USB stick, once you’ve unsealed it.
- Faulty items. If anything arrives faulty or not as described, and we’ll put it right with a repair, replacement or refund, as the Consumer Rights Act 2015 provides.
- Tracks. Some tracks are for sale. Buying one lets you play it in full on the site and download the MP3 as often as you like, from your Tracks page in the members area or the links in your receipt, under the same personal-use licence as the vault (see Music, previews and downloads). Downloads are digital content, so at checkout we ask you to agree to have them straight away: once they're available to you, you can't cancel them within 14 days. If a track is faulty or not as described, and we'll put it right or refund you. Your tracks stay on your Tracks page while your account does, so download copies to keep if you ever close it.
- Albums. Some albums are for sale whole, sometimes at a discount, shown with the full price struck out. Buying one gets you each of its tracks for sale, as if you'd bought them one by one, on the same terms as above. If you already own some of them, you pay only for the rest.
- Refunds go back the way you paid: to your card for card payments, and for bitcoin, to an address we agree with you. Refunding a track or an album takes its tracks off your Tracks page.
Nothing here affects your statutory rights as a consumer.
09Tickets for events
Tickets for some of the events on the shows page are sold through the store's checkout, so Ordering from the store applies to buying them, including paying and the time allowed to pay. For other events, tickets are sold by the promoter or venue under their own terms, and we just link to them.
- Prices. An event's tickets can come in tiers at different prices, such as an early bird with a limited number or a date it stops selling. Once a tier's sold out or past its date it's gone, and the next tier's price applies. You pay the price of the tier you chose when you ordered.
- Your tickets. Once your payment's confirmed, your tickets are on your Tickets page in the members area and in your receipt. Each has a code of its own, in its QR code, and gets one person in, once: it's marked used when it's scanned at the door. Keep your codes to yourself, as whoever shows a code first gets in with it. The name on a ticket is the name on your order, and you can give a ticket to someone else to use.
- On the night. The event is run by its venue or promoter, and their rules apply, including age limits, ID, searches and the right to refuse entry. Times, the line-up and set times can change. A ticket gets you in; it doesn't guarantee the artist plays at a particular time.
- Cancelling. Tickets are for an event on a set date, so the 14-day right to cancel that applies to most things bought online doesn't apply to them (Consumer Contracts Regulations 2013, regulation 28(1)(b)), and we can't take them back because you can't go.
- If an event's called off, we'll email you at the address on your order and refund your tickets in full. If you paid by card for the tickets alone, the refund goes back to your card straight away; otherwise (bitcoin, or an order with other things on it) we'll be in touch to arrange it. If an event's moved to another date, we'll let you know, and if you can't make the new date, before it and we'll refund you in full.
- Refunds go back the way you paid, as for store orders. Refunding a ticket cancels it, so its code won't get anyone in.
